Conditions of Sale
1.1.
Each
order you placed with us, Jebsen Beverage Company Limited, via our website www.jebsenfinewines.com
will be governed by the following Terms and Conditions.
1.2.
We
can modify the present Terms and Conditions at any time by publishing a new
version here. You agree to be bound by that update version if you place order
after we have posted it.
2.
Limitation
2.1.
It
is illegal to sell alcohol beverage (intoxicating liquor) to people below the
age of 18 under Hong Kong law. Therefore, we offer our alcoholic products only
to adults of 18 years old or above. If you place an order here, you confirm
that you are aged 18 or above. You must ensure that no person will use your
login to buy our alcoholic products. A person aged 18 or above (we require identification)
must be present to take delivery or we will withdraw and attempt delivery at
another agreed time.
2.2.
We
only accept orders for delivery within: (a) Hong Kong; and (b) the limits of
our available stocks.
2.3.
You
agree and warrant your purchase is for your personal use only, and not for
resale to anyone or making profit. We reserve the right to decline your orders if
we reasonably believe that you will resell our products.
3.
Orders
3.1.
You
can place your order by adding your selected products to My Cart.
3.2.
Once
we receive your order, we will email an order confirmation to you. However,
your receipt of a confirmation does not signify we have accepted your order,
nor does it constitute as we have confirmed our offer to sell. We are simply
confirming that we received your order.
Because we want to ensure that we
have your ordered products available, we won’t accept your order until we have
prepared them for delivery. In most cases this will be within 24 hours for
items that are in stock. We may, in our sole discretion, refuse or cancel any
order and limit order quantity. We may require additional qualifying
information prior to accept or process any order. After you receive our email
order confirmation, you can check online or Contact
Us to track your order status.
3.3.
You
must ensure all information in your order, including your delivery address and
contact details are correct. We will not be liable if we cannot deliver your
order, or have to delay delivery, if you have provided incomplete or inaccurate
information to us. Please refer to our Delivery
Terms for details.
3.4.
We
have the right to refuse your orders (with or without reasons), notably if the
product you ordered is out-of-stock or you have not fully paid your orders.
4.
Prices
4.1.
The
prices for your ordered products are those displayed on this website on the
date you place your order, excluding delivery charges. Despite our best
efforts, a small number of our products may be mispriced. If the correct price
of a product we sold is higher than our stated price, we will (at our
discretion) either: (a) contact you for instructions before delivery; or (b) cancel
your order and notify you.
4.2.
We
will bill you delivery charges at the rates indicated in our Delivery Terms section, on the date you place your
order, based on the size of your order and your selected delivery method.
4.3.
We
have the rights to: (a) modify prices and delivery charges displayed on this
website at any time; and (b) cancel your order in case of any clerical,
printing or calculation errors.
5.
Promo Codes
5.1.
To
apply a promo code, you must enter it prior to completing your order. You may
apply a promo code once only and cannot apply to previously placed orders.
Promo codes that offer a percent off may not be used in combination with other
discount or promotion.
5.2.
Promo
codes are not transferable or redeemable for cash or credit.
5.3.
Certain
products are excluded from promo code. You should check the specific details of
the promo code to which the products it applies to. We have the right to cancel
your order if you apply promo code to excluded or wrong products.
6.
Payment
6.1.
We
accept payment in Hong Kong dollar only, and only by designated credit cards,
debit cards or other electronic means which we specify from time to time.
6.2.
To
provide secure online transactions, we employ internet technology Secure Socket
Layer (SSL) / Transport Layer Security (TLS) which encrypts your personal
information, including credit card number, name and address when they travel on
the internet.
7.
Delivery
7.1.
We
will deliver your ordered products to the address you specify when placing your
order.
7.2.
Please
refer to our Delivery Terms for further
information, such as our delivery schedule and charges, and free delivery conditions.
8.1.
It
is your responsibility to verify the quantity and condition of your ordered
products at delivery.
8.2.
If
you observe damage or missing items at delivery, you must notify the courier immediately
to make a remark, and Contact Us within 2
days from your receiving the products. If it is impossible for you to notify us
within 2 days, then as soon as practicable and provide reasonably sufficient proof
to our satisfaction. Otherwise, we deem you have accepted your ordered product as
correct and of satisfactory quality.
9.
Return
Policy
9.1.
Wine
is a perishable commodity, and some may deteriorate over time or if stored
improperly, e.g. extremes of temperature. Therefore, we will (at our discretion)
accept return or replacement of product only under the following conditions:
(a) if
the product is proven to our satisfaction that, it is defective or damaged before
you accepted it; or
(b) the
product we delivered doesn’t match with your order.
You must return us with the product
in its original package, and an original receipt, delivery note or other
documentary proof of your purchase.
9.2.
We
will inspect the product and check your order against our delivery record in good
faith, but our decision will be final. We will not refund or replace any product
which is not defective or damaged, or if our delivery matches the product you have
ordered.
9.3.
If
we replace your product, you may need to collect it in person or reimburse our
delivery cost. Please refer to our Delivery Terms.
9.4.
If
we refund your order, we will determine and inform you the payment method and
refund the amount you have paid as soon as practicable.
10.
Limitation
of Liability
10.1. The photographs and texts
illustrating and describing the products on this website are non-contractual
and for information purpose only. We will not be liable for any error or
omission in the photographs or texts displayed on this website.
10.2. Our total compensation obligation
under these Terms and Conditions cannot exceed the amount: (a) we have billed
you; or (b) you have paid for your ordered products (whichever lowest). And we
have no compensation, contribution or other obligation for any consequential,
punitive, incidental, indirect or exemplary losses.
10.3. We will not be liable if we fail to perform
any of our obligation under these Terms and Conditions resulting from
circumstances beyond our reasonable control, including internet system failure,
computer glitch and hacking.
11.
Personal
Data and Privacy
Our Privacy Policy and Terms
of Use explain how we treat your personal data and protect your privacy
when you use this website. By placing an order, you agree that we can use those
data in accordance with our Privacy Policy.
12.
Applicable Law and Jurisdiction
These Terms & Conditions are
governed by Hong Kong law. Both you and we agree to submit to the non-exclusive
jurisdiction of Hong Kong courts in case of any dispute. English version of
these Terms & Conditions will prevail over the Chinese version in case of
any conflict.
